OPTUS ‘YES’ TICKETS “TOMORROW WHEN THE WAR BEGAN WORLD PREMIERE” PROMOTION

1. Information on how to enter and prizes forms part of these Terms and Conditions. Entry into the Optus ‘yes’ Tickets “Tomorrow When The War Began World Premiere (“Promotion”) is deemed to be an acceptance of these Terms and Conditions.

2. Promotion commences Thursday, July 1 2010 at 00:01 (AEST) and entries close on Saturday, 31 July 2010 at 23:59 (AEST) (“Promotion Period”).

3. Entry is only open to Australian residents who are current Optus consumer residential customers and can take the prize on Sunday, 8 August 2010 (“Eligible Entrants”). Eligible Entrants under 18 years old must have parental/guardian approval to enter and further, the parent/guardian of the Eligible Entrant must read and consent to all Terms and Conditions. Parents/guardians may be required by the Promoter to enter into a further agreement as evidence of consent to enter this Promotion. Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.

4. To enter, Eligible Entrants must, during the Promotional Period, visit www.yestickets.com.au, register their details as requested or (in the case of Eligible Entrants who are already registered members of ‘Yes’ Tickets) login to the member’s page and click on the “Anything’s Possible” link to enter. The promotional “Anything’s Possible” page will then be displayed and Eligible Entrants will be required to enter their details and submit the fully completed entry form during the Promotion Period.

5. Only one (1) entry permitted per Eligible Entrant.

6. The Promoter reserves the right, at any time, to verify the validity of entries and Eligible Entrants (including an Eligible Entrant’s identity, age and place of residence) and to disqualify any Eligible Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

8. Incomplete or indecipherable entries will be deemed invalid.

9. All valid entries received during the Promotion Period will be entered into a draw to be held on Monday, 2 August 2010 at 15:00 (AEST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The Promoter reserves the right to draw additional reserve entries and record them in case an invalid entry or ineligible Entrant is drawn.

10. The first valid entry drawn in the draw will win the prize of a trip for two (2) people to the world premiere of ‘Tomorrow When The War Began’ valued at up to $6,350 depending on point of departure. The prize includes a trip to the world premiere in Sydney, NSW with four (4) nights’ twin share accommodation in Sydney, NSW. The world premiere will take place on Sunday, 8 August 2010, but is subject to change. When attending the world premiere the winner will also attend a Meet and Greet with the stars of the film and will receive $500 spending money. If the winner is not from NSW, the prize also includes return economy airfares from the winner's nearest capital city to Sydney, NSW and return transfers from the airport to the place of accommodation. If the winner is from NSW, then the prize does not include airfares and transfers and the airfare and transfer components of the prize are not redeemable for cash.

11. Hotel incidentals, meals, taxes, insurance, transport to and from departure point, additional transfers (if applicable), items of a personal nature, in-room charges and all other ancillary costs are the responsibility of the winner.

12. The prize is subject to booking and flight availability at time of booking. The Promoter accepts no responsibility for the cancellation or rescheduling of any flights. Prize must be taken to coincide with the world premiere which will take place on Sunday, 8 August 2010. If the winner is unable to travel on the nominated date, then the Entrants is not eligible and the prize will be forfeited by the winner and the Promoter may in its discretion, award the prize to the next valid entry drawn from the remaining entries in the draw. Frequent flyer points will not form part of the prize. Prize is subject to the standard terms and conditions of individual prize and service providers. Winner may be required to present credit card at time of accommodation check in.

13. During the entire duration of the prize, a nominated parent/guardian must accompany any person under 18 years of age.

14. If the winner of the prize is under the age of 18 years, the prize will be awarded to the winner's nominated parent or guardian on behalf of the winner.

15. If the Promoter determines, in its absolute discretion, that the winner is not in the necessary condition to safely participate in the prize, the Promoter reserves the right to refuse to award to the winner any part of the prize.

16. Attendance at the world premiere of ‘Tomorrow When The War Began’ element of the prize is subject to the event venue and ticket terms and conditions, including any applicable age restriction. The Promoter and event organisers hereby expressly reserve the right to eject any winner (and/or his/her companion) for any inappropriate behaviour, including but not limited to intoxication, whilst participating in any element of the prize.

17. The “Meet & Greet” with the stars of the ‘Tomorrow When The War Began’ film awarded as part of the prize provides the winner (and his/her companion) with an opportunity to meet one or more members of the ‘Tomorrow When The War Began’ film, and an opportunity to have a photograph taken with the stars of the film. These elements of the prize are not guaranteed and are subject to the goodwill of the stars of the film on the day. The Promoter accepts no responsibility and will not offer any alternative in the event that these elements of the prize cannot be offered for any reason.

18. Total prize pool value in the Promotion is up to AU$6,350 (including GST). Prizes (including any unused portion of the prize) cannot be transferred, exchanged or redeemed for cash.

19. If the prize (or part of the prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

20. In the event that for any reason whatsoever, the winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner.

21. Winner will be notified in writing by email and phone and their name will be published in The Australian on Wednesday, 4 August 2010.

22. If the prize remains unclaimed by 15:00 AEST on Thursday, 5 August 2010 an unclaimed prize draw will take place at the same time and place as the original draw. The first valid entry drawn and successfully contacted by phone and in writing will win the prize. If the unclaimed prize draw winner cannot be contacted within 24 hours, this condition will apply to subsequent draws until a prize winner is determined. Results will be published in The Australian on Tuesday, 10 August 2010.

23. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. Prize must be taken as offered and cannot be varied.

24. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Eligible Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

25. Any cost associated with accessing the promotional website is the Eligible Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Eligible Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Eligible Entrant invalid.

26. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

27. If for any reason this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any Eligible Entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a regulatory authority.

28. It is a condition of accepting the prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.

29. The winner agrees to participate in any reasonable news and media/PR activities surrounding the Promotion. The Promoter reserves the right to use the winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.

30. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the world premiere of ‘Tomorrow When The War Began’ event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Eligible Entrant; or (g) taking of the prize.

31. All claims and entries become the property of the Promoter. The Promoter requires Eligible Entrant’s personal information in order to conduct the Promotion. If Eligible Entrants do not provide the mandatory personal information requested then they will not be able to take part in the Promotion. By entering this Promotion, each Eligible Entrant is taken to consent to the Promoter using the Eligible Entrant’s personal information to administer the Promotion, announce the winners and disclosing the Eligible Entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the Eligible Entrant is taken to consent to the Promoter’s privacy policy.
