Optus "Toy Story 3" PROMOTION
Terms and Conditions

1. Information on how to enter and prizes form part of these Terms and Conditions. Entry into this promotion is deemed acceptance of these Terms and Conditions by each Entrant.

2. Entry is limited to current Optus consumer residential and selected SMB customers aged 18 years and over (“Entrants”). Employees (and their immediate families) of the Promoter and agencies associated with this promotion are ineligible to enter.

3. Promotion commences at 12:01am (AEST) on 07/06/2010 and closes at 11:59pm (AEST) on 31/07/2010 (“Promotional Period”).

4. Entry must be made via one of the following two ways:

(a) Entrants must visit www.yestickets.com.au, register their details as requested or (in the case of Entrants who are already registered members of ‘Yes’ Tickets) login to the member’s page and click on the “Toy Story 3” link to enter. The promotional “Toy Story 3” page will then be displayed and Entrants will be required to enter their details and submit the fully completed entry form during the Promotion Period. and/or

(b) Optus Mobile customers with a capable mobile phone can enter by purchasing Disney mobile content from the Optus Zoo Disney Mobile and Optus games (WAP or web) Site available on Optus Zoo during the Promotional Period. Customers who qualify for entry will automatically be entered into the draw upon purchasing the content. Standard WAP/GPRS charges may apply. Customers may be charged up to a maximum of $9.99 (including GST) to purchase the content plus any WAP or GPRS downloading and connection charges. Browsing charges apply to navigate to the Disney mobile site from Optus Zoo. Optus Pre-Paid customer will be charged 22c flagfall per data session. Each piece of mobile content downloaded from the Disney Mobile (WAP) sites during the Promotional Period constitutes one (1) valid entry into the draw.

5. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

6. Incomplete or indecipherable entries will be deemed invalid. An Entrant must be a current Optus consumer residential or selected SMB customer aged 18 or over at the time of the draw to be eligible to win.

7. If there is a dispute as to the identity of an Entrant, the Entrant will be deemed to be the person in whose name the mobile phone account is held.

8. Multiple entries permitted, subject to the following: (a) only one entry permitted per specified entry requirement; and (b) each entry must be submitted separately and in accordance with entry requirements.

9. Entries are deemed to be received at the time of receipt into the promotional database and NOT at the time of transmission by the Entrant.

10. All valid entries received during the Promotional Period will be entered into the draw to be held on Wednesday 04/08/2010 at 15:00 (AEST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The Promoter reserves the right to draw additional reserve entries and record them in case an invalid entry or ineligible entrant is drawn.

11. The first five (5) valid entries drawn will each win an iDance Buzz Lightyear MP3 Player plus an in-season family pass for four (4) to the movie Toy Story 3 (valid at participating cinemas) valued at $143 each.

12. Redemption of the tickets is subject to any terms and conditions of the issuer including those specified on the tickets. Any ancillary or additional costs associated with attending an event, including travel to and from the event, are the responsibility of the winner.

13. Winners will be notified by e-mail and telephone within two (2) days of the draw.

14. A draw for any unclaimed prizes may take place on 05/11/2010 at the same time and place as the original draw, subject to any directions from a regulatory authority in order to award prizes of equivalent value. Winner will be notified by e-mail and telephone within two (2) days of the draw.

15. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any Entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.

16. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

17. The winners agree to participate in any news and media/PR activities surrounding the promotion. The Promoter reserves the right to use each winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.

18. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in Prize value to that stated in these Terms and Conditions; (e) any tax liability incurred by a winner or Entrant; or (f) use of any prize.

19. All entries become the property of the Promoter. The Promoter requires Entrant’s personal information in order to conduct the promotion. If Entrant’s do not provide the mandatory personal information requested then they will not be able to take part in the promotion. By entering this promotion, each Entrant is taken to consent to the Promoter using the Entrant’s personal information to administer the promotion, announce the winners and disclosing the Entrant’s personal information to organisations that assist the Promoter with administering the promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the Entrant is taken to consent to the Promoter’s privacy policy.
