Optus "MAMMA MIA! Brisbane" PROMOTION
Terms and Conditions

1. Information on how to enter and prizes forms part of these Terms and Conditions. Entry into the Optus “MAMMA MIA! Brisbane” promotion (“Promotion”) is deemed to be an acceptance of these Terms and Conditions.

2. Promotion commences Monday, June 7, 2010 at 00:01 (AEDST) and entries close at Saturday, July 18, 2010 at 23:59 (AEDST) (“Promotional Period”).

3. Entry is only open to Queensland residents aged 18 and over who are current Optus consumer residential customers and can take the prize on 11 August 2010 (“Entrants”). Employees (and their immediate families) of the Promoter, or agencies or companies associated with the conduct of this Promotion, are ineligible to enter.

4. To enter, Entrants must, during the Promotional Period visit www.yestickets.com.au, register their details as requested or (in the case of Entrants who are already registered members of ‘Yes’ Tickets) login to the member’s page and click on the “MAMMA MIA!” link for the draw they wish to enter. The promotional “MAMMA MIA!” page for the relevant draw will then be displayed and Entrants will be required to enter their details and submit the fully completed entry form during the Promotional Period.

5. Entrants are permitted to enter all three (3) draws during the Promotional Period.
a. Only one (1) entry per Dance Masterclass with Choreographer Draw permitted per Entrant during the Promotional Period.
b. Only one (1) entry per Attend a MAMMA MIA! Post Show Party Draw permitted per Entrant during the Promotional Period.
c. Only one (1) entry per Backstage Experience At MAMMA MIA! Draw permitted per Entrant during the Promotional Period.

6. The Promoter reserves the right, at any time, to verify the validity of entries and Entrants (including an Entrant’s identity, age and place of residence) and to disqualify any Entrant who submits an entry that is not in accordance with these Terms and Conditions or who tampers with the entry process. Errors and omissions will be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

7. Entries are deemed to be received at the time of receipt by the Promoter. Records of the Promoter are final and conclusive as to time of receipt.

8. Incomplete or indecipherable entries will be deemed invalid.

9. All valid entries received during the Promotional Period will be entered into the relevant draw as indicated by the Entrant on the entry form and subject to clause 5. Each draw will be held on Wednesday, July 21, 2010 at 15:00 (AEDST) at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park, NSW 2113. The Promoter reserves the right to draw additional reserve entries and record them in case an invalid entry or ineligible Entrant is drawn. Except in any unclaimed prize draw, Entrants are only permitted to win prizes in the draws that they have indicated on the entry form that they wish to be entered into.

10. Dance Masterclass with Choreographer Draw: The first ten (10) valid entries drawn in the Dance Masterclass with Choreographer draw will each win the prize of a double pass to MAMMA MIA! The Musical for the performance on Wednesday 11 August, 2010 at the Lyric Theatre, QPAC, Brisbane. The attendees will also receive a ticket to attend the Dance Masterclass with the Choreographer of MAMMA MIA! (“Session”) to be held on a date and at a dance studio to be determined by the Promoter. Each prize is valued at $450. Session can involve risk of personal injury. While the Promoter and its associated parties will take all reasonable care in the conduct of this Session, they accept no responsibility for injury or loss caused from participation in this Session or whilst participants are at or near the dance studio. The winner is responsible for ensuring that they are physically and mentally fit for the Session and during the Session must at all times take care of their own personal safety. To the extent permitted by law, the Promoter (and its franchisees) and Littlestar Services (MAMMA MIA!) and their employees shall not be liable for any claims, losses, damages, injuries, costs and expenses suffered sustained or incurred (including but not limited to indirect or consequential loss) in relation to, arising out of, or in connection with this Promotion and/or its prizes. If the Session on the determined date is cancelled by the Promoter for any reason whatsoever, then the Session will be rescheduled for another date set by the Promoter. The same terms and conditions will apply for the new Session.

11. Attend a MAMMA MIA! Post Show Party Draw: The first twenty (20) valid entries drawn in the Attend A MAMMA MIA! Post Show Party draw will each win the prize of a double pass to MAMMA MIA! The Musical for the performance on Wednesday 11 August, 2010 at the Lyric Theatre, QPAC, Brisbane. The attendees will also be invited to the ‘yes’ MAMMA MIA! Lounge for post drinks after the show with opportunity to meet some of the cast. Each prize is valued at $325. Function is for 1 hour after the performance, and it is for drinks only. The drinks included will be selected wine, beer and soft drinks only. The Promoter encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health & Medical Research Council Australian Alcohol Guidelines that are available at www.nhmrc.gov.au.

12. Backstage Experience At MAMMA MIA! Draw: The first three (3) valid entries drawn in the Backstage Experience At MAMMA MIA! draw will each win the prize of a double pass to MAMMA MIA! The Musical for the performance on Wednesday 11 August, 2010 at the Lyric Theatre, QPAC, Brisbane. The attendees will also have the opportunity to attend a backstage tour where they will meet some of the cast. Each prize is valued at $220. If the Backstage Tour on the determined date is cancelled by the Promoter for any reason whatsoever, then the backstage tour will be rescheduled for another date set by the Promoter. The same terms and conditions will apply for the new backstage tour.

13. The Promoter and its associated agencies shall not be liable in any way if any of the MAMMA MIA! Performances are cancelled, or if the performance of obligations hereunder is delayed or becomes impossible by reason of any Act of God, war, fire, earthquake, strike, sickness, accident, civil accommodation or any other cause.

14. Redemption of the tickets is subject to any terms and conditions of the issuer including those specified on the tickets. Any ancillary or additional costs associated with attending an event, including travel to and from the event, are the responsibility of the winner.

15. Prizes must be taken on the dates specified above. If the winner is unable to attend on the nominated dates, then the prize will be forfeited by the winner and the Promoter may in its discretion, award the prize to the next valid entry drawn from the reserve entries for that draw.

16. If the Promoter determines, in its absolute discretion, that the winner is not in the necessary condition to safely participate in a prize, the Promoter reserves the right to refuse to award to the winner any part of a prize.

17. Total prize pool value in the Promotion is AU$11,660 (including GST). Prizes (including any unused portion) cannot be transferred, exchanged or redeemed for cash.

18. If any prize (or part of any prize) is unavailable, the Promoter, in its discretion, reserves the right to substitute the prize (or that part of the prize) with a prize to the equal value and/or specification, subject to any written directions from a regulatory authority.

19. In the event that for any reason whatsoever, the winner does not take an element of any prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner.

20. Winners will be notified in writing by email and phone and winners of prizes valued at over $250 will be published in The Australian on Wednesday, July 28, 2010. 21. In the event that the Major Prize remains unclaimed as at 28 July 2010 the Promoter may conduct such further draws on 04 August 2010 at 15:00 AEST, as are necessary, in order to award the Major Prize in each draw. Unclaimed prize draws will take place at Optus Centre Sydney, 1 Lyonpark Road, Macquarie Park NSW 2113 and are subject to any directions from a regulatory authority. The winner of any unclaimed prize will be notified in writing. Winners of any unclaimed prizes will have their names published in The Australian on 11 August 2010.

22. The Promoter’s decision is final, and no correspondence will be entered into, including in the event of a dispute. Prizes must be taken as offered and cannot be varied.

23. If this Promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any entrant; or (b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the Promotion, as appropriate.

24. Any cost associated with accessing the promotional website is the Entrant’s responsibility and is dependent on the Internet service provider used. The use of any automated entry software or any other mechanical or electronic means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.

25. The Promoter is not responsible for any incorrect or inaccurate information, either caused by promotional website users or by any of the equipment or programming associated with or utilised in this Promotion, or by any technical error that may occur in the course of the administration of this Promotion. The Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.

26. If for any reason this Promotion is not capable of running as planned due to any reason, including but not limited to infection by computer virus, bugs tampering, unauthorised intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this Promotion, the Promoter reserves the right in its sole discretion to disqualify any Entrant who tampers with the entry process, and to cancel, terminate, modify or suspend the Promotion, subject to any written directions from a regulatory authority.

27. It is a condition of accepting any prize that the winner may be required to sign a release of liability in a form to be determined in the absolute discretion of the Promoter.

28. The winners agree to participate in any news and media/PR activities surrounding the Promotion. The Promoter reserves the right to use each winner’s name, voice, image and likeness for advertising and publicity purposes in any media in perpetuity worldwide without additional compensation.

29. Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) if the event is cancelled for any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by a winner or Entrant; or (g) use of any prize.

30. All entries become the property of the Promoter. The Promoter requires Entrant’s personal information in order to conduct the Promotion. If Entrant’s do not provide the mandatory personal information requested then they will not be able to take part in the Promotion. By entering this Promotion, each Entrant is taken to consent to the Promoter using the Entrant’s personal information to administer the Promotion, announce the winners and disclosing the Entrant’s personal information to organisations that assist the Promoter with administering the Promotion and announcing the winner, and to third parties as required by law (including authorities that regulate this Promotion). The Promoter is bound by the National Privacy Principles in the Privacy Act 1988 (Cth) and by entering the Promotion, the Entrant is taken to consent to the Promoter’s privacy policy.
